TxDOT Seeks to Renew Authority for Self-Approval of Environmental Reviews
The Texas Department of Transportation (TxDOT) is requesting federal approval to continue handling its own environmental reviews under the National Environmental Policy Act (NEPA). This authority, delegated by the Federal Highway Administration (FHWA) since 2014, aims to speed up highway projects by streamlining the review process.
Critics argue this "NEPA assignment" process undermines federal oversight, with concerns that TxDOT prioritizes project timelines over thorough environmental assessments. TxDOT, however, insists it adheres to federal regulations and highlights routine audits by FHWA as proof of accountability.
The renewal, required every five years, has drawn increased public engagement this cycle, with over 80 comments submitted, many opposing the arrangement. Public feedback is open until Monday, Dec. 9, at 10:59 p.m. CST via the Federal Register.
